Customs Officer Code of Ethics

Every civil servant shall be faithful and loyal to Pancasila, the Constitution of 1945, Country and Government, and maintain the coalescence and unity of The Republic of Indonesia.

I. Basic Principal

Every civil servant shall be faithful and loyal to Pancasila, the Constitution of 1945, Country and Government, and maintain the coalescence and unity of The Republic of Indonesia.

 

II. Personal Responsibility

Every Directorate General of Customs and Excise (DGCE) officer, whom furthermore shall be mentioned as officer, shall:

a.  take and obey oath/promise of civil servant and oath of office by virtue of the prevailing legislation;

b.  respect every citizen of different religion/belief to the Almighty God;

c.   carry out official task on his best ability and dedication with full awareness and responsibility;

d.  avoid matters that could dishonor the pride and prestige of the country, government or civil servant;

e.  avoid abuse of authority;

f.    work honestly, orderly, accurately and enthusiastically for the sake of the country;

g.  avoid entering places that could tarnish the honor or prestige of civil servant, unless for official purpose;

h.  avoid intruding the ongoing official duty;

i.    obey the official order from his official superior;

j.    guide his subordinate in carrying out their task;

k.   encourage his subordinate to enhance their work achievement;

l.    give good examples and become a model to the subordinate;

m.give opportunity to his subordinate to enhance their career;

n.  observe and settle on his best ability every report received regarding violation of discipline;

o.  be a role model as a good citizen in the community;

p.  commit a humble life in the community;

q.  always endeavor to enhance his ability, knowledge, and professionalism in carrying out his duty;

r.    obey his working hour;

s.   dress neatly and politely, and behave and act respectfully toward other civil servants and superior;

t.    maintain and enhance the integrity, harmony, coalescence and unity of the corps of civil servant.

 

III. Compliance with the Law

Every officer shall obeyand comply with the prevailing laws and formal provisions. This means that if an offence related to the legislation enforced by Customs and Excise, or in which Customs and Excise has an interest, is committed by an officer, it is considered to be a serious offence which may tarnish DGCE reputation. Therefore, an officer shall :

a.   obeyevery prevailing legislation and official regulation

b.  be aware and carry out all government provision which is directly related to his official or general duty;

c.   obeythe legislation on tax.

 

IV. Public Relations

4.1. Social Responsibility

In performing his duty, an officer shall provide his best service to the community as an actualization of his position as a public servant, therefore, an officer shall :

a.  deliver service to the community at his best ability in accordance with his field of work;

b.  avoid committingany action which may obstruct or complicate the party he serves that later may harm such party or other parties;

c.   dress neatly and properly, as well asact and behave to the community respectfully yet firmly, responsive, transparent, and professional in accordance with the prevailing provisions.

 

4.2. Public Criticism and Objection

An officer shall befully aware of the necessity of building a positive image on his performance, behavior, and integrity. In serving the public, criticisms, protests, complaints and objections from the community, colleagues and other stakeholders concerning a staff’s performance and behavior are inevitable. In dealing with such matter, an officer shall:

a.  be open-minded, show sympathetic behavior and be willing to accommodate any kind of criticism, protest, complaint, and objection;

b.  investigate the causeof the problem and provide explanation accordingly;

c.   solve problems quickly and objectively by referring to the prevailing provision;

d.  endeavour to prevent the same problem from recurring in the future.

 

4.3. Political Activity

Government officer is an element of state apparatus assigned to deliver service to the community professionally, honestly, fairly, and equally in thedutyimplementation of state, government, and development. Based on the above mentioned assignments, an officer shall:

a.  act neutral from the influence of all groups and political parties, and provide service to the community indiscriminatively;

b.  avoid becoming a member and/or committee of a political party.

 

4.4. Present or Reward for Officer

In performing his duty, an officer often deals with organizations, clients, or community members expecting a violation of prevailing procedure by promising a present or reward for the officer. In this case, the officer shall :

a.  refuse to violate the procedure and refuse presents or rewards,in any form and from any party,which areknown or suspected to be related to  the officer’s position or duty;

b.  avoid acting as a broker for a company or group in order to obtain job or order from government office/institution.

 

4.5. Conflict of Interest

Conflict of interest may arise from an officer who deals with, or from an officer whose decision is made for, people with personal interest. Therefore, an officer shall :

a.  put national interest before group or personal interest, and put aside everything from the interest of a group, person, or party which might disrupt national interest;

b.  avoid doing collaborative activities with his superior, colleague, subordinate, or another person inside or outside work for the benefit of a person, group, or party which may harm the interest of the country either directly or indirectly.

c.   avoid charging fee illegally in any form for the benefit of a person, group, or party;

d.  avoid possessing share/capital of a company whose operation is related to his work;

e.  avoid possessing share of a company whose operation is not related to his work, but the amount and nature of such possession enable him to determine the operation of the company either directly or indirectly;

f.    avoid being involved in a trading company, either officially or part time as a director, chairman, or owner of a private company for , an officer ranked IV/a and above(Pembina), or first echelon officer.

 

V. Confidentiality and Useof Official Information

An Officer, by virtue of his position,often obtains, processes, and holds classified information. Therefore, an officer shall :

a.  keep confidential the national and/or official classified information at his best ability and avoid utilizing the national secret obtained by virtue of his position for the interest of a person, group or party;

b.  avoid becoming an officer of or working for a foreign country without any permission from the government;

c.   report immediately to his superior any information on action of leaking national secret and information which may endanger or impair the state/government especially in the field of security, finance, and substantial matters.

 

VI. Use of Office Facilities

Facilities provided by the office are institutional assets to support the implementation of law enforcement duty. Unless specifically authorized, use of the office resources or facilities for personal benefit is prohibited. Therefore, an officer shall:

a.  use and maintain the state assets at his best ability;

b.  avoid abusing the state assets, capitals, or securities;

c.   avoid possessing, selling, buying, mortgaging, renting, or lending the state assets, documents, or securities illegally.

 

VII. Work Environment

Atmosphere ofa work environment which is healthy, safe and free from discrimination and disturbance will be able to improve passion to work which in the end accelerate the achievement of individual and organizational goals. Therefore, an officer shall:

a.  create and maintain a comfortable work atmosphere;

b.  act and behave firmly, but fairly and wisely to his subordinate;

c.   avoid committing vengeful action to his subordinate or another person inside or outside work;

d.  be aware, understand, and obeythe prevailing provision on standard officer uniform;

e.  avoid drug and alcohol abuse;

f.    avoid abusingfirearms and other dangerous objects.

 

VIII. Corruption, Collusion, and Nepotism

An officer shall be completely aware of and comply with all provisions related to corruption as mentioned in the Law No.31 of 1999 on the Eradication of Corruption. Any kind of corruption as referred to in the Law will be penalized with maximum penalty which may be in the form of death sentence.

Officers assigned in positions as referred to in article 2 of Law No.28of 1999 on Clean and Corruption-Collusion-Nepotism-Free Governanceshall be fully aware ofand comply with obligations as referred to in Article 5 of the Law, that are to:

a.  take oath in accordance with his religion before assuming his duty;

b.  agreeto have his assets verified before, during, and after his service;

c.   report and declarehis assets before and after his service;

d.  not commit corruption, collusion, and nepotism;

e.  perform his duty without discrimination against tribes, religions, races, and groups;

f.    perform his duty with responsibility,not commit any disgraceful act, and work without ulterior motive for the interest of a person, family, crony, or group, and not expect reward in any form which is not in accordance with the prevailing legislation; and

g.  agreeto act as witness in a corruption, collusion, and nepotism cases and other cases according to the prevailing legislation.

Any kind of offence against the provisions as mentioned in the above article will be penalized as referred to in article 20, article 21, and article 22 of Law No.26 of 1999 on Clean and Corruption-Collusion-Nepotism-Free Governance.
